Series 60 - Symbian Challenge Terms and Conditions - Oct 2004

These Terms and Conditions set forth the rules applicable to the Symbian Application Challenge (hereafter the "Challenge") organised by Orange and Nokia (hereafter the "Promoters"). By entering, the participant agrees to be bound by these Terms and Conditions, which are deemed to include all Challenge instructions and information published on the Orange Developers Portal (www.developers.orange.com).


1. General

This Challenge aims at encouraging the development of applications for use on a Nokia 6630 or the new Series 60 GPRS/3G/EDGE device, over the Symbian operating system using the Series 60 user interface. Applications can be concept at start but must be ready for launch by end of the Challenge. The most innovative applications have the potential of being commercialised over the Orange 3G network. Participants with the best applications will be short listed and receive development assistance under the conditions set forth below. The Promoters may, at any moment, put an end to or amend the Challenge with one week prior notice.


2. Duration

The Challenge will take place from September 2004 to May 2005. The Challenge timeline can be viewed on the Orange Developers Portal.


3. Eligibility

Participation in the Challenge is subject to the following requirements:

 participant must be a company
 participant must be a member of one of the developer communities 
 applications must run on WCDMA technology, and have language support, minimum English, preferably also French
 applications can be concept at start but must be ready for launch by end of the competition.

The above conditions are cumulative. Any person failing to meet any of these conditions will be disqualified. 

The Promoters retain the right to disqualify any application or participant from the Challenge for any reason and without cause. No notice will be given of such disqualification to a participant. Materials which are offensive or improper in nature, or are deemed harmful to any of the Promoters' brands will be subject to disqualification.


4. Prizes

There will be one overall winner and up to fifteen successful applications will be developed through the challenge. Successful short-listed participants will benefit from:

developing their applications closely with Orange and Nokia
 potential for a fast-track entry into the Orange product catalogue
 learning more about the Series 60 Platform 2nd edition feature pack 2 development for 3G environments
 access to free tools, including early access to the Nokia 6630 terminal
 free Symbian Signed certification (one testing round per application) 
 on-tap technical support.


5. Selection of the winners

The overall winner will be the participant who has developed the best and most creative overall applications. Applications submitted for the selection will be judged on their merits. Applications will be examined by an independent jury composed of managers of the Orange and Nokia groups of companies. The decision of the jury is final. No questions or complaints disputing the winners will be entertained.


6. Composition of the jury

Subject to modification for reason of unavailability or other relevant reasons, the jury will be composed of the following persons:

7. Entries

Participants must submit their application idea by email to developers@orange.com as a Word document or PowerPoint presentation no larger than 1mb in size.  Please put just the following text in the subject line 'Nokia_and_Orange_Symbian_Challenge_Series_60_Submission' .
Particpants' submissions must include the following information:

1. name of application and 100 word description
2. target market (based on the categories listed below)
3. business / commercial rationale for application development
4. your track record in commercial application development including success stories (and 100 word summary of your company)
5. languages supported
6. details of APIs and data bearers supported
7. second line support capabilities (e.g. hosting)
8. terminal or client / server application.

Entries must be submitted by 15 October 2004.  Any form of entry other than as specified above or any entry submitted after 15 October 2004 will be void. The Promoters accept no responsibility for any delayed entries or those not received for whatever reason, including without limitation due to internet or e-mail server failure or incorrectly addressed e-mails.

Target Market & Categories:
Applications should be innovative, commercially-sound and perfectly compatible with the technical requirements of Symbian Signed, the new Nokia Series 60 device (the Nokia 6630), and the needs of the Orange customer.

More specifically, applications that fit into one or more of the following categories:
 video telephony / video streaming
 community applications (e.g. chat, dating, mBlogging)
 travel tools and guides
 interactive gaming (sequels)
 video tones / ring tones
 screensavers / logos
 personal productivity
 enterprise applications
 communication (phone, fax, synchronization etc).


8. Use of entries

Each Participant grants the Promoters a non-exclusive licence to use its application, and any materials submitted throughout the course of the Challenge, for the purpose of testing, evaluating and assisting with the development of the application. Participants shall retain all other rights in their application and materials.


9. Communication

Participants agree to authorise and take part in any reasonable post-Challenge publicity by the Promoters. Participants agree to the use of their name, address, photograph and likeness for advertising / publicity purposes by the Promoters, and any and all rights to such use.


10. Data protection

Participants confirm their consent to the use by the Promoters (or any third party appointed by the Promoters) of any personal data provided in connection with the administration of the Challenge. The Promoters shall process any personal data in compliance with the Data Protection Act 1998.


11. Representations

Participants represent and warrant that:

 they own all rights to, and in, their application and all materials that they submit during the course of the Challenge
 the application and any materials they submit during the course of the Challenge, and their use by the Promoters in accordance with these terms, will not infringe the rights of any third party.


12. Exclusion of liability

Participants agree that the Promoters and their affiliates and agents, and the officers, employees, directors and representatives of these entities are not responsible for any losses or damages of any kind arising from or in connection with participation in the Challenge. The Promoters assume no responsibility for:

 lost, late, incomplete, misdirected, damaged or illegible entries
 any computer, telephone, cable, satellite, network electronic or Internet hardware or software malfunctions, failures, connections, garbled or jumbled transmissions, service provider/Internet/web site/use net accessibility or availability
 a participant's reliance on any advice or assistance provided by the Promoters as part of the Challenge.


13. Compliance with local law

Participants are responsible for complying with any and all applicable national laws.


14. Governing law

This Challenge is governed by English law and participants submit to the exclusive jurisdiction of the English courts.
